1. Introduction
Welcome to the Avan website. These Terms of Use (“Terms”) form a legally binding agreement between Avenga Pty Ltd (ABN 72 076 605 402) trading as Avan Campers Australia (“Avan”, “we”, “us” or “our”) and every person who accesses or uses avan.com.au, including any associated webpages, customer portals, online tools, downloadable content and digital services (collectively referred to as the Site). Avan designs, manufactures and supplies a range of Australian recreational vehicles, including campers, caravans (including pop tops and hard tops), motorhomes, accessories and related products. These Terms govern your access to and use of the Site. By accessing or using the Site, requesting information, downloading brochures, submitting an enquiry, requesting a quotation, registering a warranty, creating an online account, uploading documents, posting reviews or otherwise interacting with the Site, you acknowledge that you have read, understood and agree to be bound by these Terms. If you do not agree with these Terms, you must discontinue using the Site immediately. Nothing contained in these Terms excludes, restricts or modifies any rights or remedies available to you under the Australian Consumer Law (“ACL”) or any other law where those rights cannot legally be excluded.
2. Definitions
In these Terms, unless the context otherwise requires: ACL means the Australian Consumer Law contained in Schedule 2 to the Competition and Consumer Act 2010 (Cth). Authorised Dealer means a dealer authorised by Avan to promote or sell Avan products. Content means all information made available through the Site, including text, photographs, graphics, logos, videos, brochures, specifications, manuals, software, downloads, designs and other materials. Customer means any person who purchases, owns, enquires about or otherwise interacts with Avan products or services. Products means campers, caravans (including pop tops and hard tops), motorhomes, accessories, replacement parts and any other recreational vehicle products supplied by Avan. Site means the website located at avan.com.au together with all associated webpages, online portals, applications and digital services operated by Avan. Terms means these Terms of Use, as amended from time to time. User, you or your means every individual or entity accessing or using the Site.
3. Acceptance of These Terms
These Terms apply to every visitor, customer, supplier, dealer and other person who accesses or uses the Site. By using the Site, you agree to comply with these Terms and all applicable laws. If you access the Site on behalf of a company, partnership, trust or other organisation, you warrant that you have authority to bind that organisation to these Terms. Separate terms may apply to the purchase of Products, warranties, finance applications, promotional campaigns, competitions, servicing or other commercial transactions. Where a separate written agreement applies, that agreement prevails to the extent of any inconsistency. Avan may amend these Terms from time to time to reflect changes to legislation, business operations, Products, website functionality or industry practices. Updated Terms take effect when published on the Site unless another commencement date is specified. Your continued use of the Site after changes are published constitutes acceptance of the revised Terms.
4. Eligibility and Accounts
You must be at least eighteen (18) years of age to create an account, submit an enquiry, register a warranty, upload documents, post reviews or otherwise use any interactive functionality on the Site. If you are acting on behalf of a business or organisation, you warrant that you are authorised to do so. Certain areas of the Site may require you to create an online account. You agree to provide accurate, complete and current information and to promptly update your details if they change. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account unless caused by Avan’s negligence or a failure of our systems. If you believe your account has been compromised, you must notify Avan as soon as reasonably practicable. Avan may suspend, restrict or terminate an account where we reasonably believe these Terms have been breached, false information has been supplied, fraudulent activity has occurred, the account presents a security risk, or suspension is otherwise necessary to protect our users, systems or business operations.
5. Permitted Use of the Site
The Site is intended to provide information about Avan, our Products, Authorised Dealers and related services. Subject to these Terms, you may use the Site to: • learn about Avan Products and services; • compare product ranges and specifications; • download brochures and owner resources; • locate an Authorised Dealer; • request quotations or further information; • register warranties or submit service enquiries; • access customer support resources; and • use any other functionality that Avan makes available from time to time. You agree to use the Site responsibly, lawfully and in a manner that does not interfere with the rights of other users or the operation of the Site. You must not: • use the Site for any unlawful, misleading or fraudulent purpose; • interfere with the operation, security or availability of the Site; • attempt to gain unauthorised access to any system, database or restricted area; • introduce malware, viruses or malicious code; • scrape, harvest or extract Content using automated tools without our prior written consent; • impersonate another person or organisation; • upload unlawful, defamatory, offensive or infringing material; or • use Site Content to create competing catalogues, databases or commercial publications without our written permission. Avan reserves the right to investigate suspected misuse of the Site and to take any action reasonably necessary to protect the Site, its users and its intellectual property.
6. Product Information and Specifications
Avan uses reasonable care to ensure that information published on the Site is accurate and current at the time of publication. However, the Site is intended to provide general product information only. Specifications, dimensions, layouts, weights, capacities, colours, finishes, appliance models, optional equipment, standard inclusions and pricing may vary between production runs, model years and individual vehicles. Images, videos, virtual tours, illustrations and promotional material are provided for illustrative purposes only and may depict optional accessories, upgraded finishes or dealer-installed equipment that are not included as standard. Published measurements and technical specifications are approximate and are subject to reasonable manufacturing tolerances, engineering improvements, supplier substitutions and regulatory requirements. Avan reserves the right to modify Products, specifications, standard inclusions or available options at any time without prior notice where reasonably necessary due to product development, safety improvements, component availability, manufacturing requirements or compliance with applicable laws and standards. Customers should rely on approved quotations, sales documentation, compliance information, owner’s manuals and final build specifications rather than indicative website information when making purchasing or operational decisions.
7. Quotes, Pricing and Orders
The Site may allow you to request quotations, submit enquiries, register your interest in a Product or locate an Authorised Dealer. Unless expressly stated otherwise, all information provided through the Site is for general information purposes only and does not constitute a legally binding offer. Submitting an enquiry, requesting a quotation or expressing interest in a Product does not create a contract between you and Avan. A binding agreement is formed only when an order is accepted in writing by Avan or an Authorised Dealer and is governed by the applicable sales documentation and any related terms and conditions. Prices, estimated delivery dates, finance examples, promotional offers and product availability displayed on the Site are indicative only and may change without notice. Variations may occur due to changes in manufacturing costs, supplier pricing, freight charges, exchange rates, taxation, regulatory requirements or product improvements. Avan reserves the right to correct pricing errors, typographical mistakes or inaccurate product information published on the Site at any time. Where promotions or special offers are advertised, they are subject to their individual terms and conditions, availability, participating dealers and applicable timeframes.
8. Authorised Dealers
Avan distributes its Products through a network of Authorised Dealers located throughout Australia. Authorised Dealers operate as independent businesses. Unless expressly stated otherwise in writing, they are not agents of Avan for the purpose of entering contracts, collecting payments or making representations on Avan’s behalf. Individual dealers may determine their own retail pricing, delivery charges, trade-in valuations, finance arrangements, installation services and customer support processes. Where you submit an enquiry through the Site, Avan may respond directly or refer your enquiry to the most appropriate Authorised Dealer based on your location or the nature of your request. Any personal information shared for this purpose will be handled in accordance with our Privacy Policy. Avan is not responsible for representations, warranties or commitments made independently by an Authorised Dealer unless those representations have been expressly authorised by Avan in writing.
9. Custom Configurations, User Uploads and Online Services
The Site may allow you to upload or submit documents, photographs, drawings, specifications, measurements, reviews, warranty information or other material in connection with product enquiries, custom configurations, warranty claims, service requests or other online services (“User Submissions”). You retain ownership of your original User Submissions. However, by submitting content through the Site, you grant Avan a non-exclusive, worldwide, royalty-free licence to use, reproduce, store, adapt and communicate that material for purposes including: • responding to your enquiry; • preparing quotations; • assessing product suitability; • engineering and manufacturing; • warranty administration; • servicing and technical support; • product development; • quality assurance; and • improving our Products and services. You warrant that any User Submission: • belongs to you or that you have authority to provide it; • does not infringe another person’s intellectual property or privacy rights; • is accurate to the best of your knowledge; • complies with applicable laws; and • does not contain malicious software or harmful code. Avan may decline to accept, remove or edit User Submissions where reasonably necessary to protect our systems, comply with legal obligations or maintain the integrity of the Site. Where a User Submission relates to a proposed custom configuration, Avan may recommend changes to improve safety, compliance, manufacturability or product performance. No custom configuration becomes final until confirmed in writing through the relevant ordering process.
10. Warranty Registration and Customer Services
The Site may provide access to online services including warranty registration, service requests, replacement part enquiries, owner resources and technical support. You agree to provide complete and accurate information when using these services. Avan may request supporting documentation, including proof of purchase, photographs, service records or compliance information, where reasonably required to assess a request. Submitting a warranty registration or warranty claim through the Site does not automatically establish entitlement to warranty coverage. All warranty claims remain subject to inspection and assessment under the applicable warranty terms. Any warranty provided by Avan operates in addition to your rights under the Australian Consumer Law.
11. Recreational Vehicle Safety
Campers, caravans and motorhomes involve inherent risks and must be operated responsibly. Owners and operators are responsible for ensuring their recreational vehicle is suitable for its intended use and is operated, maintained and serviced in accordance with applicable legislation, the owner’s manual and manufacturer recommendations. For campers and caravans, customers are responsible for ensuring: • the towing vehicle has sufficient legal towing capacity; • tow ball loading and payload limits are observed; • safety chains, electrical connections and braking systems are correctly connected; and • the vehicle is loaded safely before travel. For motorhomes, customers are responsible for ensuring the vehicle is operated within its Gross Vehicle Mass (GVM), axle load limits and any applicable licensing requirements. Unauthorised structural modifications, suspension changes, gas or electrical alterations, chassis modifications or the installation of incompatible aftermarket accessories may affect safety, compliance and warranty coverage. Information published on the Site is general in nature and is not intended to replace professional engineering, mechanical, towing or safety advice.
12. User Reviews and Community Content
Where the Site permits users to submit reviews, ratings, comments or other public content, that content must be lawful, respectful and based on genuine experience. You must not publish material that is misleading, defamatory, offensive, discriminatory, unlawful or that infringes another person’s rights. By submitting reviews or other public content, you grant Avan a perpetual, worldwide, royalty-free licence to reproduce, publish, edit, adapt and use that content for purposes including customer communications, marketing, product improvement and promotional activities. Avan reserves the right, but is not obliged, to moderate, edit or remove user-generated content where reasonably necessary to maintain the quality, integrity or lawful operation of the Site. Publication of user-generated content does not constitute endorsement by Avan.
13. Intellectual Property
Unless otherwise stated, all intellectual property appearing on the Site, including text, graphics, photographs, logos, product names, brochures, manuals, specifications, videos, software, website design and other Content, is owned by or licensed to Avan and is protected under applicable intellectual property laws. You are granted a limited, revocable, non-exclusive licence to access and use the Site for your personal, lawful and non-commercial use. Except where permitted by law or with Avan’s prior written consent, you must not reproduce, distribute, modify, publish, sell, create derivative works from or otherwise commercially exploit any Content made available through the Site. Any ideas, suggestions or feedback voluntarily provided to Avan regarding the Site or our Products may be used by Avan without restriction or any obligation to compensate you.
14. Privacy
Avan respects your privacy and is committed to protecting personal information collected through the Site. Personal information is collected, used, stored and disclosed in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles and Avan’s Privacy Policy. Depending on how you interact with the Site, we may collect information such as your name, contact details, product enquiries, warranty information, purchase details and any other information you voluntarily provide. This information may be used to: • respond to enquiries; • prepare quotations; • administer warranties and service requests; • communicate with Authorised Dealers where appropriate; • improve our Products, services and website; • send marketing communications where permitted by law; and • comply with legal and regulatory obligations. The Site may use cookies and similar technologies to improve website functionality, analyse visitor behaviour and enhance the user experience. You may manage cookie preferences through your browser settings, although some features of the Site may not function correctly if cookies are disabled. Avan does not control or endorse third-party websites and is not responsible for their content, availability, privacy practices, security, products, services or terms of use. Your use of third-party websites or services is entirely at your own risk and subject to the terms imposed by those providers.
16. Disclaimers
The Site is provided on an “as is” and “as available” basis. While Avan uses reasonable efforts to ensure that information published on the Site is accurate and current, we do not warrant that the Site will always be uninterrupted, error-free, secure or free from viruses or other harmful components. Information published on the Site is intended as general information only and should not be relied upon as engineering, legal, financial, taxation, mechanical, towing or other professional advice. Specifications, dimensions, layouts, colours, weights, capacities, appliance models, optional equipment and other technical information are indicative only and may vary between production runs, manufacturing tolerances and individual recreational vehicles. Product images, brochures, videos, virtual tours and promotional material are illustrative only and may depict optional equipment or accessories not included as standard. Where any inconsistency exists between information published on the Site and approved sales documentation, compliance information or owner’s manuals, the approved documentation will prevail. Nothing in this clause excludes any rights that cannot lawfully be excluded under the Australian Consumer Law.
17. Limitation of Liability
Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law or any other applicable legislation. Subject to those rights, and to the maximum extent permitted by law, Avan will not be liable for any indirect, incidental, special or consequential loss arising from or in connection with your use of the Site. This includes, without limitation, loss of profits, revenue, business opportunity, goodwill, anticipated savings, reputation or data. To the extent permitted by law, Avan is not responsible for losses arising from: • reliance on information published on the Site; • temporary interruptions or unavailability of the Site; • cyber incidents or unauthorised access by third parties; • unauthorised modifications to recreational vehicles; • misuse or improper maintenance of Products; • services supplied by independent third parties or Authorised Dealers; or • events beyond Avan’s reasonable control. Where legislation permits Avan to limit its liability for services supplied through the Site, our liability is limited, at our option, to re-supplying the relevant services or paying the reasonable cost of having those services supplied again.
18. Indemnity
To the maximum extent permitted by law, you agree to indemnify and hold harmless Avan, its directors, employees, contractors and related entities against claims, liabilities, losses, damages and reasonable legal costs arising directly from: • your breach of these Terms; • your unlawful use of the Site; • your User Submissions; • your infringement of another person’s rights; or • your breach of applicable laws. This indemnity is reduced to the extent that any loss is caused or contributed to by Avan’s negligence or breach of these Terms.
19. Suspension and Termination
Avan may suspend, restrict or terminate your access to the Site where reasonably necessary to: • protect the security or integrity of the Site; • investigate suspected misuse; • comply with legal obligations; • perform maintenance; • protect other users; or • respond to operational requirements. Termination of your access to the Site does not affect any rights or obligations that accrued before termination. Clauses relating to intellectual property, privacy, disclaimers, limitation of liability, indemnity and governing law survive termination of these Terms.
20. General Provisions
Avan may update these Terms from time to time. Updated Terms take effect when published on the Site unless otherwise stated. If any provision of these Terms is found to be invalid or unenforceable, that provision will be read down or severed to the minimum extent necessary, and the remaining provisions will continue in full force and effect. A failure or delay by Avan to exercise any right under these Terms does not constitute a waiver of that right. Avan may assign or transfer its rights and obligations under these Terms without restriction. You may not assign your rights or obligations without Avan’s prior written consent. Avan is not responsible for delays or failures resulting from circumstances beyond our reasonable control, including natural disasters, supplier failures, utility interruptions, industrial action, cyber incidents, government action or other force majeure events.
21. Governing Law
These Terms are governed by the laws of the State of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of Victoria and the Commonwealth courts of Australia sitting in Victoria in relation to any dispute arising out of or in connection with these Terms or the Site.

Nothing in these Terms is intended to exclude, restrict or modify any consumer rights or remedies available under the Australian Consumer Law or any other legislation that cannot lawfully be excluded. Where legislation permits Avan to limit its liability for services provided through the Site, Avan limits its liability, at its election, to the re-supply of those services or the payment of the reasonable cost of having those services supplied again.
